Fees for our Services will be set forth in a separate service agreement or statement of work. Unless otherwise specified, all fees are quoted in Kuwaiti Dinar (KWD) and are non-refundable.
We will invoice you according to the payment schedule agreed upon in the service agreement. Payment methods accepted include credit card, bank transfer, or other methods as specified.
If you fail to make any payment when due, we reserve the right to suspend or terminate your access to the Services and may charge late payment fees at the maximum rate permitted by the applicable laws of the State of Kuwait.
We warrant that the Services will be performed with reasonable skill and care and in accordance with industry standards. Your exclusive remedy for breach of this warranty shall be the re-performance of the Services.
EXCEPT AS EXPRESSLY PROVIDED HEREIN, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
WE DO NOT WARRANT THAT: (A) THE SERVICES WILL FUNCTION UNINTERRUPTED, SECURE, OR BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICES WILL MEET YOUR REQUIREMENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IDEVELOPRS CO., ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
(A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;
(B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
(C) ANY CONTENT OBTAINED FROM THE SERVICES; AND
(D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT,
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO US DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
You agree to defend, indemnify, and hold harmless iDeveloprs Co., its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

You may terminate your account and discontinue use of the Services at any time by providing written notice to us, subject to any specific terms in your service agreement.
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the Services will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of Kuwait, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts of the State of Kuwait. Where the parties have agreed in a separate signed agreement to resolve disputes by arbitration, that agreement shall govern.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of iDeveloprs Co.
These Terms, together with any service agreement or statement of work, constitute the entire agreement between you and iDeveloprs Co. regarding your use of the Services and supersede all prior and contemporaneous written or oral agreements between you and iDeveloprs Co.
